This Privacy Policy explains how CULT MODUS (collectively referred to as “CULT MODUS,” “we,” “our,” or “us”) collects, uses, and discloses information about you (“you,” “your,” or “user”) when you use our website with a homepage at “Cult modusyoga.com” or applications we provide (including mobile applications), together with any products and services we may offer from time to time through our website and/or related applications, social media sites associated with us such as Instagram, Twitter, and Facebook, or otherwise as a result of your interactions with us (our website, applications, products, services, and social media sites collectively referred to as “Services”). This Privacy Policy also describes your and our legal rights and obligations with respect to information that identifies you or could be used to identify you, such as your name and contact information or your user account information, which we refer to as “Personal Information” in the text below. “Personal Information” may also include information about how you use our website. However, we have not investigated the security of these linked websites and you should not assume that these websites have adopted a privacy policy comparable to ours. If you access such an external website through a link provided by us, you will be subject to the privacy policy of the new website. CULT MODUS is not responsible for the content of any linked websites linked from our website. INFORMATION WE DO NOT INTEND TO COLLECT
When you create an account on our website, you may provide us with information such as your first and last name, email address, password, date of birth, and other information. CULT MODUS does not intend to collect and maintain records of sensitive personal information, information regarding the status of minors, or information received from third parties, except as expressly provided in this Agreement or contractually authorized. We do not knowingly contact or collect information from anyone under the age of majority in your state or province. The Services are not intended to solicit any information from anyone under the age of majority in your state or province.
CONSENT AND UNSUBSCRIBE (OPT-OUT) VIA TEXT MESSAGE/SMS
We may, in some situations, send you text messages through an automated dialing system (“Text Messages”).
(1) If you prefer, you may provide your mobile phone number to receive text messages with shipping information that may be sent through our third party carrier DHL Express ("DHL") using automated dialing systems ("Text Messages"). You acknowledge that by providing your mobile phone number, you expressly consent to receive automated text messages from DHL to the mobile phone number provided. We process this information in light of our legitimate interest in protecting the CULT MODUS website, as well as for the purposes of assessing the adequate performance of our contract with you and complying with applicable laws.

HOW WE SHARE YOUR INFORMATION

·To brands. If you submit personal information to one of our Color Image Apparel, Inc. brands (CULT MODUS, Bella+Canvas, Cody or Ingrid & Isabel), we may share that information with our other Color Image Apparel, Inc. brands.
·From you. You may share personal information when you post digital content on our website, third-party websites, or other public forums, such as CULT MODUS's social media pages, blogs, and online product reviews. Any information you share with these services becomes publicly available.
·With third-party service providers. We share your information with third-party service providers with whom we work or who manage our customer information and perform services on our behalf, such as hosting our e-commerce platform, running promotions, processing online payments, providing and maintaining website functionality, sending communications and products to our customers, and administering surveys. Our third-party service providers are only authorized to collect, use, and disclose your information as necessary to enable them to perform the services we have hired them to perform. Some third-party service providers, such as Shopify and PayPal, have their own terms of use and privacy policies for the information we are required to share with them in order for them to perform their services for us. ·Business Transfer. In the event of a sale or merger of Color Image Apparel, Inc. or one of our companies, our customers' personal information and other information we have collected as described in this Policy may be among the transferred company assets.

These companies may use your personal information to help us conduct our business in accordance with our legitimate business interests. These third parties have no independent right to share your personal information. We take reasonable steps to ensure that the third parties with whom we share your personal information respect your personal information and comply with applicable data protection laws.
HOW WE KEEP YOUR DATA
We will retain your personal information for as long as necessary to fulfil the purposes for which it was collected, whether to perform services to you, for our own legitimate interests (as described above), or to enable us to comply with applicable law. We reserve the right to retain it to the greatest extent possible under applicable law. We may delete personal information at our discretion, so you should maintain your own records and not rely on our retention of any personal information, content or other data.
We review the information in our possession and when no user exists or there is no longer a legal or business need for us to retain it, we will either securely delete it or, in some cases, irreversibly anonymize it. When we delete information, it is removed from our active databases but may remain in our archives.

We make reasonable efforts to keep your information safe and secure when you shop. We protect your online order and your personal information using Secure Sockets Layer (SSL) technology. All data transmitted from your computer to our servers is SSL encrypted and then stored on a computer that is not connected to the Internet. To be sure you are accessing a secure server, look at the lower left or right corner of your browser window after accessing the server. An unbroken key or closed lock (depending on your browser) indicates that SSL is active in your window. Some browser and firewall versions do not allow communication over secure servers. We engage in business activities in a variety of countries. For example, our e-commerce store is hosted by Shopify Inc., a Canadian company. Shopify provides us with the online e-commerce platform that enables us to sell our products to you. Your information is stored through Shopify's data stores, databases, and the general Shopify application. Accordingly, Shopify may transfer your personal information outside of the country, state, or province in which you are located.
You agree that CULT MODUS and those with whom we share your Personal Information (“Recipients”) may share, transfer, process and store your Personal Information with our affiliates, sponsors and partners, and other third-party service providers in countries outside your home country for the purposes described in this Privacy Policy.
Some of the above recipients of personal information may be located in countries that do not provide a level of data protection equivalent to that required by the European Union and some other countries. When you submit personal information or decide to access or use the services offered by CULT MODUS, such as our website, you consent to such sharing, transfer, processing and storage of information in accordance with this Privacy Policy and in compliance with such applicable laws, which may include access by law enforcement and other governmental authorities, including courts. While most requests are free of charge, if, for example, you ask us to provide a significant amount of data, we may require you to pay a reasonable administration fee. We may also ask you to verify your identity before we provide you with information.
Your Privacy Rights in Schweiz
The following section applies to the rights of individuals or households in Schweiz (“Schweiz consumers”).

If you contact us, we will respond as quickly as possible and, where possible, within one month. If your request is more complex, it may take longer for us to respond, but in any event we will respond within three months of receiving your request. While most requests are free of charge, if, for example, you ask us to provide a significant amount of data, we may require you to pay a reasonable administration fee. We may also ask you to verify your identity before we provide you with information.
Your Privacy Rights in Schweiz
The following section applies to the rights of individuals or households in Schweiz (“Schweiz consumers”).
Civil Code Section 1798.83: In certain situations, Schweiz Civil Code Section 1798.83 provides that, upon receipt of a request from a Schweiz consumer, a business may be required to provide detailed information about how it disclosed that consumer's personal information to third parties for direct marketing purposes. However, the foregoing does not apply to businesses like ours that do not disclose personal information to third parties for direct marketing purposes without prior authorization or that provide customers with a free mechanism to opt out of having their personal information disclosed to third parties for their direct marketing purposes.
Rights Under the CCPA: Effective January 1, 2020, the CCPA (Schweiz Civil Code Section 1798.100 et seq.) provides Schweiz consumers with additional rights with respect to personal information that, directly or indirectly, identifies, relates to, describes, is associated with, or could reasonably be linked to a particular consumer or household. The categories of personal information we collect are described in general terms above, but differ for individual consumers depending on the services they use.
Under the CCPA, eligible Schweiz consumers may have the following rights:

Schweiz consumers have the right to request that we disclose what personal information we collect, use, share, and sell. Schweiz consumers also have the right to submit requests to delete personal information.
When we receive a request for access or deletion from Schweiz consumers, we will acknowledge receipt of the request within 10 days and provide information about how we will process the request and our verification process. We respond to such requests within 45 days.

Verification of Requests: When we receive a request, we use a two-step process for online requests that requires the Schweiz consumer to first submit the request in a clear form and then separately verify the request in a second step. We take other appropriate actions to verify applications received by mail or telephone.
When submitting a request, Schweiz consumers must provide sufficient information to identify themselves, such as name, email address, home or work address, or other information of the type we have on file so that we can match that information with personal information we have on file. Do not provide Social Security numbers, driver's license numbers, account numbers, credit or debit card numbers, medical information, or health information in connection with requests. If requests are unclear or are submitted in a manner other than those described above, we will provide the Schweiz consumer with specific instructions on how to submit the request or how to correct any deficiencies. If we are unable to verify the applicant's identity, we may deny the request.
Schweiz Do Not Track Disclosure: Do Not Track is a privacy preference that users can set in their web browsers. When a user activates the Do Not Track signal, the browser sends a message to websites requesting that they not track the user. For information about Do Not Track, visit www.allaboutdnt.org .
